Information regarding prizes and how to enter forms part of these Terms and Conditions. By entering, entrants accept these Terms and Conditions.

  1. PROMOTION TIMING: The NETGEAR Anytime, Anywhere Sweepstakes (the “Sweepstakes”) begins 2:00 p.m. United States Eastern Standard Time (EST)/7:00 p.m. Greenwich Mean Time (GMT) on 23 November 2009/ 6.00am Australian Eastern Daylight-saving Time (AEDT) on 24 November 2009 and ends 5:00 p.m. EST/10:00 p.m. GMT on 19 January 2010/ 9:00 a.m. (AEDT) on 20 January 2010 (the “Promotion Period”).
  2. HOW TO ENTER: There are four ways to enter the Sweepstakes: Sweepstakes Website, Twitter Method, Tell-A-Friend method and Alternate Entry Method.
    1. Sweepstakes Website: During the Promotion Period, go to http://www.anytimeanywheresweeps.com, complete all required information requested on the online entry form and click “Submit” to receive one entry.
    2. Twitter Method: You will automatically receive one entry in the Sweepstakes when you become a follower of NETGEAR on Twitter (http://www.twitter.com/netgear) during the Promotion Period. If you were already a follower of NETGEAR on Twitter prior to the start of the Promotion, you will automatically receive one entry in the Sweepstakes provided that you remain a follower of NETGEAR during the Promotion Period. For the avoidance of doubt, if you withdraw from being a follower of NETGEAR on Twitter during the Promotion Period, your corresponding entry will be deemed invalid.
    3. Tell-A-Friend Method: For each friend you refer, you will receive one additional entry into the Sweepstakes (up to ten friends). To refer friend(s), you must provide each friend’s first name and email address you refer on the Tell-A-Friend form on the Sweepstakes Website.
    4. Alternate Entry Method: If you prefer not to become a follower of NETGEAR on Twitter, or not to tell up to ten friends about the sweepstakes, you may instead receive those eleven entries (that is, the entries outlined in paragraphs b and c above) in the Sweepstakes by sending an email during the Promotion Period with your name, address, city, state or territory, Zip or postal code, country, date of birth, and phone number to: bonusentries@anytimeanywheresweeps.com.

    3. Limit one entry per person or email address via Sweepstakes Website method of entry, and one entry per person or email address via the Twitter method of entry, and ten entries via the Tell-A-Friend method of entry, for a total maximum entry limit of 12 entries per person in the Sweepstakes during the Promotion Period. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void such entries and that entrant may be disqualified at the sole and absolute discretion of the Administrator of the Sweepstakes. Use of any automated system to participate is prohibited and will result in disqualification. The Promoter accepts no responsibility for any late, lost, incomplete, misdirected, incorrectly submitted or delayed entries whether due to error, omission, alteration, tampering, theft, destruction or otherwise. Normal Internet access and usage charges imposed by your on-line service may apply.

  3. RANDOM DRAWINGS: The Grand Prize Package winner will be the first entry randomly selected from among all eligible entries on 20 January 2010 (EST and GMT time zones) and 21 January 2010 (AEDT time zone). One Weekly Prize Package winner will be randomly selected in each of eight weekly drawings on the following dates, from among all eligible entries received as of 11:59 p.m. EST/ 4:59 a.m. GMT/ 3:59 p.m. AEDT on the following weekly draw close dates:
    1. EST time zone: 29 November 2009, 6 December 2009, 13 December 2009, 20 December 2009, 27 December 2009, 3 January 2010, 10 January 2010 and 17 January 2010; and
    2. GMT and AEDT time zones: 30 November 2009, 7 December 2009, 14 December 2009, 21 December 2009, 28 December 2009, 4 January 2010, 11 January 2010 and 18 January 2010

    4. All draws will be conducted at 10:00 a.m. AEDT, with the weekly prize draws on 1 December 2009, 8 December 2009, 15 December 2009, 22 December 2009, 29 December 2009, 5 January 2010, 12 January 2010 and 19 January 2010. The draws will be conducted by Greeneagle Distribution & Fulfillment at Unit 10, 20 Ricketty Street, Mascot, NSW 2020, Australia, an independent judging organization whose decisions are final on all matters relating to the Sweepstakes. Odds of winning are dependent upon the number of eligible entries received as indicated above. Winners will be notified by mail within 2 days of the relevant prize drawand prizes will be delivered to winners within 28 days of the relevant prize draw.

  4. PRIZES AND RECOMMENDED RETAIL PRICES (“RRP”): One (1) Grand Prize Package: A Samsung 52” HD TV, an Acer Aspire One Netbook, an iPod Touch, a NETGEAR® Digital Entertainer™ Live media player, a NETGEAR® The Ultimate Networking Machine router model WNDR3700 and a NETGEAR® Stora device (RRP U.S.$3,097/AU$3,354). Eight (8) Weekly Prize Packages: Each consists of NETGEAR® Digital Entertainer™ Live media player, NETGEAR® The Ultimate Networking Machine router model WNDR3700, and NETGEAR Stora device (RRP U.S.$569/AU$616 each). Total RRP of all prizes = U.S.$7,649/AU$8,281. Prize values and currencies determined as at 9 November 2009. The Promoter accepts no responsibility for changes in prize value or currency conversion rates. Prizes are nontransferable or exchangeable, cannot be redeemed for cash and must be accepted as awarded. No substitutions may be made, except by NetGear Australia Ltd Pty (the “Promoter”) in the event that a prize (or portion of prize) cannot be awarded for any reason, in which case, Promoter will award a prize of equal or greater value, subject to the approval of gaming authorities in each jurisdiction, where required.
  5. ELIGIBILITY: Open to legal residents of the 50 United States of America and the District of Columbia, United Kingdom, Australia and New Zealand who are 18 years of age or older as of date of entry. Employees of Promoter, its affiliates, subsidiaries, advertising and promotion agencies, including AlterSeekers, Inc., and their immediate family members and/or those living in the same household of each are not eligible. Void where prohibited or restricted by law. All federal, state, and local laws and regulations apply.
  6. GENERAL RULES: Potential Grand Prize winner will be required to sign and return a Certificate of Eligibility, Liability Release, and where legal, a Publicity Release within ten (10) days of notification attempt. Noncompliance within this time period will result in disqualification and an alternate winner will be selected in accordance with Rule 7. If prize notification is returned as non-deliverable, the potential winner will be disqualified and an alternate winner will be selected in accordance with Rule 7. If Grand Prize winner is a U.S. resident: A 1099 tax statement will be filed with the IRS for that winner. By accepting prize, winner agrees that the Promoter and those acting under the Promoter's authority, may use winner's name, picture/portrait/video likeness, and/or voice, for advertising and promotional purposes without further consideration, unless prohibited by law. An entrant is not a winner of a prize unless and until entrant’s eligibility has been verified and entrant has been notified that verification is complete. Potential winners must continue to comply with all terms and conditions of these Terms and Conditions, and winning is contingent upon fulfilling all eligibility requirements. Return of prize or prize notification as undeliverable or inability of Promoter to contact a potential winner may result in disqualification and alternate selection. Entrants agree to be bound by these Terms and Conditions and the decisions of the judges. All entries become the sole property of Promoter and none will be acknowledged or returned. In the event of a dispute, entries will be deemed made by the authorized account holder of the e-mail address submitted at the time of entry. The "authorized account holder" is deemed the natural person who is assigned to an e-mail address by an Internet access provider, service provider or other online organization that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address. A potential winner may be requested to provide Promoter with proof that the potential winner is the authorized account holder of the e-mail address associated with the winning entry. If for any reason the Sweepstakes is not capable of running as planned, including due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failure, human error or any other causes beyond the reasonable control of Promoter that corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Sweepstakes, Promoter reserves the right in its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Sweepstakes and award prizes from among all eligible entries received prior to cancellation or termination, subject to the approval of gaming authorities in each jurisdiction, where required. Promoter assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, entries. The Promoter and its associated agencies and companies are not responsible for any problems or technical malfunction of any telephone network or lines, computer online systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Promoter on account of technical problems or traffic congestion on the Internet or at any web site, any combination thereof, or otherwise, including any injury or damage to entrant's or any other person's computer related to or resulting from participation or downloading any materials in the Sweepstakes. The Promoter and its associated agencies and companies will not be liable for any damage in transit to prizes. CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, PROMOTER RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
  7. SECOND CHANCE DRAW: In the event of the prize not being accepted or claimed within 3 months of the draw, the relevant winner’s entry will be deemed invalid and the Promoter reserves the right to conduct such further draws at 3:00pm AEDT on 20 April 2010 at the same location as the original draws as are necessary to distribute the prizes, subject to any written directions given by any relevant authority. In the event of any winners, their names and state/territory of residence will be published in The Australian newspaper on 26 April 2010.
  8. WINNERS LIST: For a list of winners, available after 26 April 2010, please visit http://www.anytimeanywheresweeps.com/winners.aspx. Each winner’s name and state/territory of residence will also be published in The Australian newspaper on 28 December 2009 (first four weekly draws) and 25 January 2010 (last four weekly draws and Grand Prize Package winner).
  9. PRIVACY: The information entrants provide will be used by the Promoter for the purpose of conducting this Sweepstakes. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this Sweepstakes or communicating with entrants. The Promoter may, unless otherwise advised, use the information for future promotional, marketing and publicity purposes including sending electronic messages or telephoning entrants. If an entrant does not wish to be contacted for these purposes or wishes to access, update or correct any personal information, they should contact the Promoter at the address below. A copy of the Promoter’s Privacy Policy in relation to treatment of personal information may be obtained at http://www.netgear.com/About/PrivacyPolicy.aspx.
